General Participation & Liability Waiver

NANTUCKET ANGEL WARRIORS — PARTICIPATION AGREEMENT, LIABILITY RELEASE, AND MEDIA CONSENT Nantucket Angel Warriors LLC ("NAW") runs social, athletic, creative and service programs for teenagers on Nantucket. This agreement is signed by the participating teen's parent or legal guardian, on the teen's behalf and on their own behalf, as a condition of the teen taking part. Please read all ten sections. There is no deadline — take the time you need. 1. VOLUNTARY PARTICIPATION Participation in NAW programs is entirely voluntary. These programs are recreational and social. They are not school, not a required activity, and not a condition of receiving any essential service. The participant may decline any activity at any time without penalty. 2. THE ACTIVITIES NAW events take place at NAW premises and at host venues around Nantucket, and include, without limitation: - racket sports, fitness and other athletic activity - cooking and food preparation, involving knives, heat, open flame and food allergens - art, studio and craft activity, involving tools and materials - media, writing and workshop sessions - film, performance and other entertainment - talks, service projects and volunteering - events at waterfront and club premises - travel to, from and between these locations on Nantucket 3. ACKNOWLEDGMENT AND ASSUMPTION OF RISK I understand these activities carry inherent risks that cannot be eliminated regardless of the care taken. Those risks include, without limitation: slips, trips and falls; collisions with people, equipment or fixed objects; cuts, burns and scalds; allergic reactions, including from cross-contamination; exposure to weather; risks arising on or near the water; risks arising in transit; and the acts or omissions of other participants. I knowingly and voluntarily assume all such risks, both known and unknown, on the participant's behalf and on my own. 4. RELEASE AND WAIVER OF LIABILITY In consideration of the participant being permitted to take part, I release, waive and discharge Nantucket Angel Warriors LLC, its organizers, directors, officers, employees, volunteers, host venues and their staff (together, the "Released Parties") from all claims, demands, damages, liabilities, losses and expenses arising out of or relating to the participant's participation, to the fullest extent permitted by Massachusetts law. This release covers claims arising from ordinary negligence. It does NOT release, and nothing in this agreement shall be read to release, any claim arising from gross negligence, recklessness, or willful or wanton misconduct, and it does not waive any right that cannot lawfully be waived. 5. MEDICAL AUTHORIZATION AND HEALTH INFORMATION I authorize NAW staff and host venue staff to obtain emergency medical care, including transport, for the participant if they judge it necessary, and I accept financial responsibility for the cost of that care. I confirm that the contact, medical, allergy and dietary information I have provided is accurate and complete, and I will keep it current. I will tell NAW and the relevant venue about any allergy, dietary restriction or medical condition before an event it affects. 6. CODE OF CONDUCT The participant is a guest at an esteemed venue. Every participant agrees to: - treat other participants, staff, volunteers and venue property with respect at all times - honor each venue's own rules and requirements for attendance - follow reasonable instructions from NAW staff, volunteers and venue staff - refrain from harassment, discrimination, bullying, profanity, and any conduct that endangers the health, safety or wellbeing of others - refrain from alcohol, tobacco, vaping and drugs at NAW events NAW may remove a participant from an event or suspend participation for conduct that breaches this section. Where a participant is removed from an off-site event, NAW will contact the parent or guardian. 7. PHOTO AND NAME RELEASE I give written consent for NAW to use the participant's name, photograph, likeness and recorded voice, and my own, in: - N.A.W. Times News, the weekly newsletter - NAW websites and applications - NAW social media accounts, including Instagram and Facebook - NAW fundraising, grant and sponsor materials This consent is given without payment. NAW will not sell this material or license it for third-party advertising. I may withdraw this consent for future use at any time by writing to NAW. NAW will then stop using the material and remove it from NAW-controlled channels where reasonably practicable, but cannot recall material already printed, distributed, or shared by others. 8. TRANSPORTATION Where NAW or a host venue provides or coordinates transportation, I consent to the participant travelling on that basis. Where the participant travels independently, I remain responsible for their travel to and from the event. 9. ELECTRONIC SIGNATURE AND RECORDS I agree that signing this agreement electronically has the same legal effect as signing on paper. I understand that NAW records the name I type, the date and time, and technical information about the device and connection used, as evidence of this signature, and that NAW will email me a copy of what I agreed to. 10. GOVERNING LAW, SEVERABILITY, AND ENTIRE AGREEMENT This agreement is governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-law rules, and any action relating to it shall be brought in the courts of the Commonwealth. If any provision is held invalid or unenforceable, it shall be limited or severed to the minimum extent necessary and the remainder shall continue in full effect. This agreement is the entire agreement between the parties on its subject matter and supersedes any earlier version. It remains in effect for all NAW programs and events until withdrawn in writing. Individual events may additionally require a host venue's own waiver. ACKNOWLEDGMENT I have read this agreement in full. I understand that I am giving up substantial legal rights on behalf of the participant and on my own, including the right to sue for ordinary negligence. I am the participant's parent or legal guardian, I am at least 18 years old, and I sign freely. By typing my name and checking the box, I agree to all ten sections above on the participant's behalf and my own.
